Program Administration

The Fentanyl Free Communities Foundation (FFCF), a 501(c)(3) nonprofit organization, has established and will administer this communications campaign known as the PAUSE program.

Use of Name and Image

You grant the Fentanyl Free Communities Foundation (FFCF) and its affiliates, contractors, and subcontractors the right to use your name, image, and contributions to the PAUSE program in promotional materials, including but not limited to social media posts, advertisements, and press releases. This is a royalty-free, worldwide, perpetual license.

Contractor Status

You acknowledge that you are participating in the PAUSE program as an independent contractor and not as an employee of the FFCF or any of its affiliates, contractors, or subcontractors. As such, you are responsible for managing your tax obligations and any other legal responsibilities related to independent contractor status. FFCF will provide you with the appropriate tax documentation for submission.

Compliance with Messaging

You agree to adhere strictly to the messaging guidelines provided by the FFCF and not to deviate from the approved content and messaging strategy. This is to ensure consistency and accuracy in the information disseminated through the PAUSE program.

You commit to using only officially approved messaging sourced from the following authoritative websites, which are regularly updated:

You also agree to incorporate guidance and directives as communicated by the administrators of the Fentanyl Free Communities Foundation. You may use your own language and style to convey messaging, provided it aligns with the spirit of the official guidelines laid out by these sources.

Indemnification

You agree to indemnify, defend, and hold harmless the FFCF, its directors, officers, employees, agents, contractors, subcontractors, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with your participation in the PAUSE program, your violation of these Terms and Conditions, or your violation of any rights of another.

Content Ownership and Rights

You agree that any content created for the PAUSE program may be used by the FFCF at their discretion without any further compensation or notice to you. The FFCF reserves the right to modify, reproduce, distribute, and use the content in connection with the PAUSE program across any media.

Confidentiality and Non-Disparagement

You must keep confidential any proprietary or confidential information shared with you by the FFCF during your participation in the PAUSE program and refrain from disclosing it to any third party without the prior written consent of the FFCF. Additionally, you agree not to make any disparaging comments about the FFCF or its programs.

Data Protection and Privacy

Your personal data will be handled and protected in accordance with applicable data protection laws. The FFCF is committed to maintaining the confidentiality and integrity of your personal information.

Feedback and Communication

Participants are encouraged to provide feedback or report issues related to the program through specified mechanisms. The FFCF will monitor and provide feedback on performance and communications to influencers, ensuring compliance and continuous improvement of the program.

Dispute Resolution

In the event of a dispute, parties agree to engage in good faith mediation as a first step to resolve issues, thereby protecting both the influencers and the FFCF from extensive legal entanglements.

Changes to Terms and Conditions

The FFCF reserves the right to modify these terms and conditions at any time. Continued participation in the program after such changes will constitute your acceptance of the new terms.

Termination

The FFCF reserves the right to terminate your participation in the PAUSE program at any time, without cause or notice, if it is deemed that your continued involvement may be harmful to the objectives of the program or is in violation of any of these Terms and Conditions.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Minnesota, without regard to its conflict of law provisions.

Program Goals and Objectives

The mission of the PAUSE program is to spread awareness and amplify official government-sanctioned information to help mitigate the use of fentanyl, whether knowingly or unknowingly, and to prevent death from fentanyl and related substances.

Compensation and Payment

Influencers will be compensated as independent contractors for their participation, receiving payment per influence, engagement, or campaign via Venmo or other online cash transaction apps. Payment details will be provided upon acceptance into the program.

Duration and Scope of Participation

Participation duration is based on performance and the discretion of the FFCF. Influencers may conclude their participation at any time.

Social Media Platforms and Real-World Communication

Influencers are expected to use all main social media platforms and participate in real-world communication efforts to disseminate the program’s messages.

Training and Support

The FFCF will provide influencers with up-to-date information from trusted sources like the CDC, NIH, and SAMHSA, ensuring they are well-equipped to be key communicators.

Performance Metrics

The FFCF will monitor the effectiveness of influencers, with potential for preferred participant status or termination based on influence and engagement.

Content Approval Process

Preapproved content will be provided to influencers, who can convey messages in their own language and style. The FFCF will monitor to ensure adherence to the messaging parameters.

Age Requirements and Identity Verification

Influencers must be 18+ years of age. Age and identity will be verified through uploaded government ID via the online application platform.
